Terms of Service

1. The Service

HypesYou turns a website or app link into a brand brief and helps you create, schedule and publish short-form content - image carousels and short videos with AI voiceover, captions and music - to social platforms you connect, and shows you how that content performs. Features may change as we improve the Service. During early access, some features may be limited or labelled beta.

2. Eligibility and accounts

• You must be at least 18 years old and able to enter into a binding contract.
• You must give accurate account information and keep your login secure. You are responsible for activity under your account.
• Tell us promptly at hello@hypesyou.com if you suspect unauthorized use of your account.

3. Connected platforms

When you connect TikTok, Instagram or Facebook, you authorize HypesYou to act on that account as described in our Privacy Policy - mainly to publish content you created or approved and to read its performance. You remain bound by each platform's own terms and community guidelines, and you are responsible for complying with them.

Platforms can change or limit their APIs at any time. We are not responsible for a platform rejecting, removing, limiting or delaying a post, or for actions a platform takes on your account.

4. Your content

• You own the content you provide (links, briefs, notes, uploads) and the posts created for you in the Service ("Your Content"), to the extent the law allows.
• You grant us a limited, worldwide, non-exclusive licence to host, process, adapt and transmit Your Content only to provide the Service - for example to generate posts and publish them to the accounts you choose. This licence ends when Your Content is deleted from the Service.
• You confirm you have all rights needed for Your Content, including images, logos, music and trademarks you upload, and that it does not infringe anyone's rights.
• You are responsible for everything published from your accounts, including posts published automatically by a campaign set to "straight to profile". Review your campaign settings and drafts carefully.

5. AI-generated content

• The Service uses AI to generate text, images and voice. AI output can be inaccurate or unexpected, and similar output may be generated for other users.
• We design the Service to use only facts from your brief, your notes and researched sources ("zero invented facts"), but you must check that every post is accurate, lawful and not misleading before it is published, especially claims about prices, results, health, finance or competitors.
• Where a platform requires it, HypesYou labels content containing AI-generated images or voice using that platform's disclosure tools. You must not remove required labels or present AI-generated people or events as real in a misleading way.

6. "What's working" formats

The "What's working" library shows examples of publicly available posts together with an analysis of their format, so you can create original posts in a similar format. Example posts belong to their authors. You may use the format - hook type, structure, pacing - but you must not copy other creators' text, images, videos or other protected elements.

7. Acceptable use

You must not use the Service to:

• publish content that is illegal, hateful, harassing, sexually explicit, violent, deceptive or that infringes intellectual property or privacy rights;
• publish fake reviews, fake testimonials, invented statistics or misleading health, financial or political claims;
• send spam, manipulate engagement or impersonate any person or brand;
• break any platform's rules, automation limits or community guidelines;
• reverse engineer, overload, scrape or try to gain unauthorized access to the Service or other users' data;
• resell the Service without our written permission.

We may remove content, pause publishing or suspend accounts that break these rules.

8. Plans, payment and taxes

• Paid plans are billed in advance, monthly or annually, through Stripe. By subscribing you authorize recurring charges until you cancel.
• Each plan includes the limits shown on our pricing page (for example posts per month and AI image credits). Unused posts and credits do not roll over unless we say otherwise.
• Prices exclude taxes unless stated. Applicable taxes (such as VAT) are added at checkout.
• We may change prices with at least 30 days' notice. Changes apply from your next billing period, and you can cancel before they take effect.
• Payments are non-refundable except where required by law or stated otherwise in writing. Consumers in the EU keep their statutory withdrawal rights where applicable.

9. Waitlist and early access

Joining the waitlist is free and does not guarantee access, a specific plan or a specific price. We invite people in waves at our discretion. Early-access features may change or be withdrawn.

10. Cancellation and termination

• You can cancel your subscription at any time in your account settings. Your plan stays active until the end of the paid period.
• You can delete your account at any time. We delete your data as described in the Privacy Policy.
• We may suspend or terminate your access if you seriously or repeatedly break these Terms, if required by law, or if a platform requires it. Where reasonable, we will notify you first.

11. Our intellectual property

The Service, including its software, templates, design and the HypesYou name and logo, belongs to us or our licensors. These Terms give you a limited, non-transferable right to use the Service during your subscription. Feedback you send us may be used to improve the Service without obligation to you.

12. Third-party services

The Service relies on third-party services such as social platforms, AI providers, stock image providers and Stripe. Their terms apply to your use of them, and we are not responsible for their availability or actions.

13. Disclaimers

The Service is provided "as is" and "as available". We do not promise any particular number of views, followers, sales or other results, or that the Service will be uninterrupted or error-free. Nothing in these Terms limits rights that cannot be limited by law, including consumer rights.

14. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damages, lost profits, lost data or reputational harm, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to liability that cannot be excluded by law, such as for intent or gross negligence.

15. Indemnity

If you are a business user, you agree to compensate us for claims by third parties arising from Your Content or your breach of these Terms or of platform rules, including reasonable legal costs.

16. Governing law and disputes

These Terms are governed by the laws of [jurisdiction to be confirmed], and disputes will be resolved by the courts of [venue to be confirmed], unless mandatory consumer protection law gives you the right to bring proceedings in your country of residence.

17. Changes to these Terms

We may update these Terms. For material changes we will notify you by email or in the app at least 14 days in advance. If you continue to use the Service after the changes take effect, you accept the updated Terms; if you do not agree, you can cancel before then.
